2 Presentation of the Application
Kidmemo is a mobile application for creating a memory journal for children (photos, videos, notes), intended for private and family use.
The Application also allows recording information related to the child's follow-up (growth data, appointments, vaccinations, treatments, etc.), for purely informative and personal purposes.
3 Acceptance of Terms
The use of the Application implies full and complete acceptance of these Terms. In case of disagreement, the user must stop using the service.
4 Access to the Service
Access to the service requires the creation of an account. The Application is reserved for adults with legal capacity.
The user is responsible for the confidentiality of their credentials. The user agrees to take all necessary measures to protect their credentials and avoid unauthorized access to their account. The user is responsible for any activity performed from their account.
5 Published Content
The user remains the owner of the content (texts, images, videos) they publish. The user guarantees they have all the necessary rights for their distribution and have obtained the required authorizations for content involving third parties, especially minors.
It is forbidden to publish illegal, violent, hateful, defamatory content or content that violates privacy. Kidmemo reserves the right to delete any non-compliant content without notice.
The user grants Kidmemo a non-exclusive, free, and limited license to host, store, reproduce, and display content solely for the operation of the Application.
The user refrains from using the Application in a fraudulent, abusive manner or contrary to its purpose.
6 Health Data and Use of the Application
Information related to health (growth data, vaccines, treatments, medical appointments, etc.) is entered by the user for strictly informative and personal purposes. The user is solely responsible for the accuracy of the information entered.
Kidmemo does not provide any medical advice, diagnosis, or recommendation. The Application is not a substitute for a health professional and must not be used to make medical decisions.
7 Sharing and Access to Content
The user can share certain content with third parties. The user is solely responsible for the people with whom they share access and the consequences of this sharing. Kidmemo cannot be held responsible for the use of content by third parties authorized by the user.
8 Availability of the Service
Kidmemo implements reasonable means to ensure the availability of the service. The service is provided "as is", without warranty of:
- absence of interruption,
- absence of errors,
- complete preservation of data,
- suitability for the user's specific needs.
9 Limitation of Liability
Within the limits authorized by law, Kidmemo cannot be held responsible for data loss, service interruptions, or indirect damages related to the use of the Application.
The user acknowledges that, despite the measures implemented, no computer system can guarantee a total absence of data loss. The user is invited to keep a copy of their important content. Kidmemo cannot be held responsible for any data loss.
Kidmemo cannot be held responsible for damages resulting from fraudulent access to data despite the security measures implemented.
In any case, Kidmemo's liability, all damages combined, is limited to the amount possibly paid by the user during the 12 months preceding the dispute.
10 Notifications
The Application can send notifications related to the use of the service, subject to the user's consent. The user can activate or deactivate them at any time from the Application settings or their device settings.
11 Evolution of the Service and Economic Model
Kidmemo may offer a free version, a trial period, paid features, or advertising content. Features and access conditions may evolve at any time.
Kidmemo also reserves the possibility to modify, suspend, or stop all or part of the service at any time.
12 Account Deletion and Suspension
The user can delete their account at any time. This deletion results in the deletion of associated data within a reasonable time (generally within 30 days), subject to legal obligations and technical constraints.
Certain data may be temporarily kept in backup systems or to meet legal obligations.
Kidmemo reserves the right to suspend or delete an account in case of non-compliance with these Terms.
13 Modification of the Terms
These Terms can be modified at any time. In case of significant modification, users will be informed in the Application.
14 Force Majeure
Kidmemo cannot be held responsible in case of force majeure or an event reasonably beyond its control, especially in case of failure of networks or hosting services.
15 Applicable Law
These Terms are subject to French law.
